IPS officer wants FIR against him quashed, moves Gujarat HC

Sharma, in his petition, contented that all charges
against him were false.

He said the alleged incident had taken place in 1984,
following which an FIR was registered then, in which he
was not included as an accused.

There cannot be two separate FIRs for an incident which
had same facts and circumstances, he said, adding the complaint
against him has been lodged with a malafide intention.

The 1976 batch IPS officer further contended that since
the case is 26-year-old, witnesses and documents in the
matter would not be available which could cause prejudice to
his defense. Hence, the FIR needs to be quashed, his petition
said.

The CID had lodged an FIR against Sharma and three others
on August 10 based on an application by one Jusab Juma Mokha,
of Kutch, which stated that Sharma, who was posted as the
Superintendent of Police there, along with other policemen,
had allegedly killed five members of his family including
father, elder brother and uncle in 1984.
