Patna: Describing the imposition of President's rule in Uttarakhand as 'undemocratic' and 'unconstitutional', Bihar Chief Minister Nitish Kumar on Monday said the Centre ignored the Supreme Court judgement which says that the majority should be tested on the floor of the House.
"Imposition of President's rule in Uttarakhand is completely undemocratic and unconstitutional. In its judgement, the Supreme Court has made it clear that the majority should be tested on the floor of the House," Kumar told reporters here at assembly premises.
He said there was no justification for imposing President's rule in Uttarakhand when the assembly was scheduled to meet on March 28.
In a dig at the NDA, Kumar said that if it (Centre) wants to promote defections, then it should have removed the provisions of 10th schedule from the Constitution.
"A new law has been added to the 10th Schedule which says that no one can engineer defections in the party. No one can even think of defecting party if their numbers (legislators) are less than two-thirds....It is a mockery of 10th Schedule," he said.
"If it wants to promote defections in such a brazen manner then it should scrap the provisions of 10th Schedule," the Chief Minister added.
"It is something like promoting defections which is a complete violation of Constitution. It is the responsibility of people sitting at Centre to protect and implement it. Otherwise democracy would be weakened (with such incidents)," Kumar said.
