Mumbai: The Bombay High Court on Monday suggested Maharashtra government to consult religious leaders while framing a policy on shrines obstructing public places.
"The government while framing the policy should also consult various religious leaders and take their suggestions," the HC remarked adding if the BMC decides to take action against those structures built after the Supreme Court order
it may do so in accordance with law.
A division bench of justices Ranjana Desai and RG Ketkar today heard a petition filed by the Bombay Catholic Sabha (BCS) which has challenged the recent demolition of crosses in Byculla of south Mumbai by the Brihanmumbai Municipal Corporation (BMC) following an order passed by the Supreme Court on September 25, 2009.
The Maharashtra government today filed an affidavit stating that Chief Minister had stayed demolition of all unauthorised religious structures on public roads through a Government Resolution dated March 14, 2011 until a proper
policy is framed.
The affidavit said that the unauthorised religious structures that have come up after the Supreme Court order would be demolished by the BMC.
The BCS, in view of the GR, today withdrew its petition.
The HC observed that since the state government has decided to frame a policy, unauthorised construction of the religious shrines should not happen in future.
