Cuttack: The Orissa High Court on Tuesday could
not take a decision on whether the writ filed by former
additional judge of the court Justice Lalit Kumar Mishra
merits admission for adjudication.
A division bench of Chief Justice V Gopala Gowda and
Justice Harjinder Singh Bhalla, after listening to the pleas
made by the petitioner`s advocate P K Ray for over two hours,
adjourned the matter to be heard again on December 16.
Justice Mishra, a former additional judge of the HC who
was reverted back to district judge cadre in January this year
and subsequently given compulsory retirement, had filed the
writ petition in July seeking a direction to the Union
government for implementing the Supreme Court`s recommendation of appointing him as a permanent judge of the HC.
Mishra was elevated to the HC bench as an additional
judge in January 2008 after serving 15 years as a direct
recruit district judge.
