Trust case: Raj HC restrains cop from use of coercive measures

The Rajasthan HC asked police not to use any coercive measures against the trustees of the Pt Deen Dayal Trust (DDT), which has Vasundhara Raje as its chairperson, but restrained from staying probe into its missing files.

Jaipur: The Rajasthan High Court on Thursday asked
police not to use any coercive measures against the trustees
of the Pt Deen Dayal Trust (DDT), which has former Chief
Minister Vasundhara Raje as its chairperson, but restrained
from staying an investigation into its missing files.

Raje and 14 other trustees were named in an FIR in the
alleged missing of files concerning the registration of the
trust with the Devstahnan Department. The case was filed on
the direction of a local court last year.

Justice Karni Singh Rathore pronounced the order on an
appeal filed by one of the trustees.

ADJM Puran Sharma had on December 22 directed police to
register an FIR against all the trustees, including Raje, and
a few others over missing of original files of registration
concerning the trust memorandum of association, registration,
accounts and audits.

An FIR was registered in February last year, though a
complaint was filed in 2006. When the police started a probe,
it surfaced that the files were missing.

Complainant Shri Krishan Kukkad filed a second complaint
under section 156 (3) to bring to book the guilty and this was
challenged by trustee Ashok Parnami.

It was alleged that the trustees including Raje entered
into a criminal conspiracy to steal and destroy the documents
to obstruct criminal proceedings.
