Bihar govt seeks stay on CBI probe

Bihar govt today sought a stay on Patna HC order for a CBI probe into alleged financial irregularities in development schemes from 2002 to 2008.

Patna: Bihar government today sought a stay
on the Patna High Court order for a CBI probe into alleged
financial irregularities in development schemes from 2002 to
2008, pleading that CAG report on the issue was pending
"consideration" of Public Accounts Committee (PAC) of the
state assembly.

In an Interlocutory Petition filed in the High Court
today, ahead of the scheduled hearing in the court of Chief
Justice R M Doshit and Justice S K Katriyar on July 26, the
state government has sought a stay on the operation of CBI
inquiry on the basis of CAG report.

The CAG report was presented in the state assembly on
July 14, 2009 after the approval of the state governor and
subsequently, referred to Public Accounts Committee (PAC) of
the house for consideration, the petition filed by Chief
Secretary Anoop Mukherjee on behalf of the state government,
said.

In the petition, the state government has raised certain
questions, while seeking modifications or clarifications on
the High Court`s order dated July 15, 2010 for a CBI inquiry.

The government in its petition has said whether a court
can order a probe by any agency, including CBI, relying on
CAG report which was "under consideration" of the state
legislature.
