Delhi court acquits two in gang rape case

A Delhi court acquitted a man and his elder brother of the charges of gang rape of the former`s wife two years ago, saying her allegations were not "convincing".

New Delhi: A Delhi court acquitted a man and
his elder brother of the charges of gang rape of the former`s
wife two years ago, saying her allegations were not
"convincing".

Additional Sessions Judge Vinod Kumar found no substance
in the woman`s allegations and absolved Naseem and his
elder brother Haseen of the charges.

"In fact, the story of committing rape by a person with
the wife of his brother in a small room when the husband of
the woman is sleeping does not appear to be convincing," the
court said, terming the charges as "highly doubtful".

The woman had lodged an FIR with Subzi Mandi police
station in old Delhi on October 30, 2007, alleging her husband
had rained blows on her when she complained to him of rape by
his elder brother.

ASJ Kumar, however, rejected her testimony saying, "I am
of the opinion that this (beating) is unnatural behaviour of a
husband when his wife has been raped."

The victim, who also accused her husband of dowry
harassment as her father had given Rs 50,000 to her husband
for purchasing three-wheeler, could not impress the court
which allowed the husband`s contention that it was a financial
support on the part of his father-in-law.

"In her complaint, FIR and testimony before the court,
there is only a vague allegation (by woman) that the husband
and family members were not happy with the dowry," the court
said.
