Supreme Court agrees to hear Gujarat bar association's plea in January

New Delhi: The Supreme Court collegium on November 18 has rejected the Centre`s plea for "reconsideration" of 43 names recommended for appointment as judges in various high courts and sent the files back to the government.

on Tuesday agreed to hear the Gujarat Bar Association`s plea in January 2017 against Centre`s refusal to transfer Justice MR Shah despite the Supreme Court collegium clearing it.

A bench of the apex court, headed by Chief Justice of India Tirath Singh Thakur and two other judges decided to hear the Gujarat bar`s plea in January 2017.

The Supreme Court collegium on November 18 has rejected the Centre`s plea for "reconsideration" of 43 names recommended for appointment as judges in various high courts and sent the files back to the government.

The three-judge Supreme Court collegium of Chief Justice TS Thakur and Justices AR Dave and JS Khehar today took the unanimous view that it would stick to its recommendations, including the 43 candidates, after discussing the matter over the past two days.

By convention, the Centre will now have to appoint the 43 as judges.

On November 11, the Centre had sent back for reconsideration 43 of the 77 names the collegium had recommended for posting as judges in high courts.
