New Delhi: Rohit Shekhar, who is seeking to declare 88-year-old N D Tiwari as his biological father on Monday moved a fresh plea in the Delhi High Court to gain access to the DNA test report of the veteran Congress leader that had mentioned the youth as his son.
"This court be pleased to allow this application to grant access to the applicant (Rohit) to the DNA test report, already on record, to get details of the author of the DNA test so as to enable the applicant herein to summon her/him to record his/her evidence," the plea said.
The court, on July 27, last year, read out the findings of DNA profiling tests conducted at Centre for DNA Fingerprinting and Diagnostics (CDFD) at Hyderabad on Tiwari, 67-year-old Ujjwala Sharma and Rohit.
The tests results said Ujjwala and Tiwari were biological parents of Rohit. However, the court had then ordered that the details of the reports be kept confidential.
In the fresh plea, Rohit, 33, has sought to examine the author of DNA reports by gaining access to the confidential findings of CDFD as the recording of evidence was on in the case.
Meanwhile, Rohit has also filed another plea seeking transfer of the case to a Joint Registrar for recording of evidence on day-to-day basis as local commissioner Bimla Makin, former Additional District Judge, has expressed her inability to proceed with the case.
Earlier, Makin, appointed as the local commissioner, had recorded the statements of Ujjwala Sharma. She testified saying Tiwari had assured her that he intended to adopt Rohit.
The court had ordered day-to-day hearing in the case after Tiwari refused to settle it through mediation process.
In response to a suggestion that the DNA test result is a conclusive kind of evidence and the matter can be settled, the counsel for Tiwari said he would contest it as there was a possibility that the medical evidence may not be accurate.
The high court had on July 27 last year read out the DNA report that had declared Tiwari as Rohit`s biological father.
Tiwari had given blood sample for the DNA test on May 29 in Dehradun following an apex court order in the case, after repeatedly contesting against undergoing the test.
Rohit, in 2008, had filed the suit seeking to declare Tiwari as his biological father.
