New Delhi: The Supreme Court on Friday
dismissed the petition filed by Delhi MLA Shoaib Iqbal against
the verdict of the Allahabad High Court on the Ayodhya
dispute, saying it is "misconceived".
"The petition is misconceived. Hence dismissed," a
Bench headed by Chief Justice S H Kapadia said without even
giving any chance for arguments.
The petition filed by the Lok Janshakti Party MLA said
the judgement, which held that the place where the makeshift
temple of Lord Rama currently exists belongs to Hindus, is
based on "faith and belief" and as such it is against the
constitution.
The MLA, who was not a party to the dispute on the title
suits before the Lucknow bench of the High Court, had
contended the demolished Babri Masjid was the property of the
Wakf since 1528 AD.
In its petition, the politician had sought a stay on the
September 30 judgement of the High Court.
