Retrenched employees not entitled for absorption: Alld HC

The Allahabad High Court today held that retrenched employees of corporations like UP State Sugar Corporations Ltd, Cement Corporation and Bhadohi Woollen Mills were not entitled for absorption into various govt departments.

government departments.

The order was passed by a division bench comprising
Justices Ashok Bhushan and Virendra Singh on a special appeal
filed by the Uttar Pradesh government, challenging a single
judge order that directed for absorption of retrenched
employees of the aforesaid bodies.

Appearing on behalf of the state government, Chief
Standing Counsel M C Chaturvedi argued that rights of
retrenched employees under the UP Absorption of Retrenched
Employees in Public Corporation Rules, 1991, had been taken
away in terms of the Recession Rules, 2003, and subsequently
by the Recession Act, 2009.

The court agreed with the submission and held that
such employees were not entitled to be absorbed into
government departments.
