UP: HC to hear plea on restoring anticipatory bail

The Allahabad High Court fixed August 26 as the next date of hearing on a writ petition.

Lucknow: The Allahabad High Court on Monday fixed
August 26 as the next date of hearing on a writ petition,
seeking direction for restoring the provision of anticipatory
bail in Uttar Pradesh.

The order was passed by a division bench comprising
Justice Uma Nath Singh and Justice Anil Kumar in Lucknow bench
of the High Court on a writ petition filed by Ram Nayak
Tiwari.

On behalf of the Central government (Home Affairs), a
statement was made that the Criminal Procedure (UP Amendment)
Bill 2010 would be placed before the President of India within two weeks for receiving presidential assent.

The court observed that "it would be highly appreciable
if the views of the central government are given due respect
in restoring the omitted provisions of section 438 Crpc
(Anticipatory) bail in terms of the existing Central law".

As per the order issued by the court on August 1 under
secretary, pension cell, Ministry of Home Affairs Vijay
Tehlan was present in court on behalf of the ministry.
